Artists retain copyright of their own work at all times, unless they have expressly granted, in writing, permission allowing your use of one of their images (a fee is normally charged). All artist’s images and written content shown on this site are copyright to the individual artists and may not be downloaded, copied or reproduced in any way without the permission of the artist concerned.
When an artist creates a Mobile Greeting Card they are giving Mobtal.com express permission to allow their images to be used in a specific product format. Artists retain full copyright of their M-Card image at all times.
The buyer of a Mobile Greeting Card is legally bound by the Website Terms of Use and Privacy Policy and will infringe the artists copyright if any attempt is made to upload the image to another device or medium without the artist’s knowledge and express written consent. A customer buying the artist’s artwork is not permitted to use the artwork image as a Mobile Greeting Card (M-Card) and will be in breach of the artist’s copyright if he does so.
Mobile Greeting Cards (M-Cards) can either be downloaded to your own phone as wallpaper or sent to another person’s phone as a greeting card with a message.
The M-Card image will automatically re-size to fit any mobile / cell phone and cannot be forwarded or uploaded to another device. Mobile / cell phone users can view M-Cards at wap.mobtal.com on the mobile web.
The terms Cell Phone and Mobile Phone are interchangeable.
Please choose your username carefully when applying for membership as we do not have the ability to alter it at a later date.
Membership is available to professional, semi-professional and amateur visual artists.

A PayPal Business/Premier account is a requirement if you intend to:
Sell your art online and receive payment from customers
Sell your own M-Cards and receive payment from Mobtal
You must write your public profile in the English language and present your artwork in a reasonable and satisfactory manner abiding by the Website Terms of Use.
We suggest you type up your profile and biography on to a word document, check for spelling and punctuation, then copy and paste it into the required fields on the application form. You are required to submit images of your three best pieces of art.

Your account will be activated once we have confirmed receipt of your payment.
You may cancel your membership at any point within the first 14 days and receive a full refund. Cancelling your membership after 14 days will not entitle you to a refund.

PayPal allows you to have your own PayPal Personal Account in addition to a Business/Premier Account.

Each time you sell an M-Card you will receive a fixed payment (25p from a £1.50 GBP sale) allowing you to calculate the exact amount of money you are earning. You will be able to check your sales data in your admin area. If, by the end of that particular Billing Period your sales total reaches Mobtal’s Payment Threshold (£50) you will receive payment by the Payment Date shown below:
Billing Period - 1 April to 30 September / Payment Date - 31 December
Billing Period - 1 October to 31 March / Payment Date - 30 June
Payment is initiated with a Self Billing Report at the end of each Billing Period and your income will be deposited into your PayPal Business/Premier Account by the date shown above.

The category ‘Charity/Non-profit’ has been designed for registered charities based in Australia, Canada, England, New Zealand, Northern Ireland, Scotland, United States or Wales.
Please select a charity/non-profit sub-category when applying for membership. We have purposely designed the sub-category descriptions to be very broad in their scope (e.g. Wildlife) for organisations that are involved in a wide range of activities whilst also creating very specific categories (e.g. Animal Ι Protection Ι Orangutans Ι Borneo) for organisations that focused on a particular cause.
Please contact us prior to membership if you feel your charity could benefit from the creation of a specific category to highlight your particular cause.
To help promote awareness for your cause you will receive a Charitable M-Card page. This will allow artists to donate their M-Card profit to your organisation. The M-Card page will also display your charity registration number (if applicable) and provide visitors a direct link to the donation page on your own website.
Funds generated due to charity M-Cards are the result of what we term ‘indirect fund raising’. The amazing generosity of the artist combined with the customer’s love of the artist work results in a small but vital donation to your cause.
In order to promote ‘direct fund raising’ we have added a Donation button on the artwork page itself and your Charitable M-Card page so that interested visitors can donate directly to your cause.
Artists may choose to support your cause by donating the profit from an M-Card sale to your organisation (25p from a £1.50 GBP sale). At the end of each Donation Period the money raised will be paid to you by the Payment Date shown below:
Donation Period - 1 April to 30 September / Payment Date - 31 December
Donation Period - 1 October to 31 March / Payment Date - 30 June

To make a purchase online please click the ‘Add to basket’ button next to the artwork you wish to buy. You will then be presented with one or more delivery options. You can only purchase one artwork from one artist at one time.
After selecting your preferred method of delivery you will be taken to the PayPal website. A secure payment page will have an identifiable padlock symbol and a URL address that begins https: (and not http). Please see www.paypal.com for more details. The shopping cart system does not cater for the purchase of multiple artworks from different artists.
Once you have checked the details of your shopping cart are correct press the ‘Proceed to checkout’ button to complete the process
You will then be sent an ACKNOWLEDGEMENT OF ORDER email confirming your order from PayPal.
The ACKNOWLEDGEMENT OF ORDER is not acceptance of your offer.
If your offer has been accepted you will be contacted by the artist via email confirming the details of your order (ORDER CONFIRMATION). Your offer to buy has now been accepted and a legally binding contract will be formed between you and the artist. Your artwork will then be despatched to you.
If none of the delivery options the artist provides meet your requirements you should send the artist an enquiry.
Do not make any form of payment until you and the artist are in full agreement on the method of delivery and cost.
Mobtal.com and the artists that use this website do not have any access to credit or debit card details.
Both parties should make a note of dates and times of contact. The buyer should record the dates, times and method of payment. If you wish to place an order offline, you may send a letter of enquiry to the artist with details of your order which should include your name, address, telephone number, email address and any questions about payment and delivery.
When sending this letter you are making an offer to buy. The artist will respond in writing.
When your offer has been accepted you will receive details of the artists preferred method of payment, it will be at this point that a legally binding contract will be formed between you and the artist.
When payment has been received and cleared your order will be despatched.
All orders offline are between you and the artist.
Both parties should make a note of dates and times of contact. The buyer should record the dates, times and method of payment. The artist should keep the post and packaging receipt as proof that the artwork has been despatched. When the artwork has been delivered the buyer should keep a record of the delivery date, time and relevant paperwork.
You must immediately send a written NOTICE OF CANCELLATION to the artist informing him that you no longer want the artwork. You as a consumer are protected by the Consumer Protection (Distance Selling) Regulations 2000 and the SafeBuy code of practice. Please see the following links:

Under the Consumer Protection (Distance Selling) Regulations 2000 you are entitled to a 7-day cooling off period. This means you have the right to cancel in writing up to 7 working days after you have received your purchase for any reason whatsoever. The SafeBuy code of practice extends that period to a 14-day cooling off period after receiving your purchase.
Please ensure you keep all receipts.
If, after receiving your NOTICE OF CANCELLATION, it turns out that your artwork has not been sent then the artist will refund you the full amount of your purchase.
You must immediately send a written NOTICE OF CANCELLATION to the artist informing him that you no longer want the artwork. The SafeBuy code of practice gives you up to 14-days after receiving the purchase in which to send a written Notice of Cancellation to the artist.
You are now responsible for ensuring the safe return of the artwork back to the artist:
You must send the artwork back to the artist in its original packaging. Ensure you have proof of postage, proof of receipt and adequate insurance so that matters of loss or damage can be dealt with separately.
Please keep all receipts. We recommend you return the artwork using a special delivery postal service for your own protection and peace of mind.
Upon the safe return of the artwork to the artist you will receive a full refund.
Your transaction with the artist then comes to an end.
You are not legally entitled to a refund for an artwork that was specially created for you.
If you have sent a NOTICE OF CANCELLATION but the artist states that he has already despatched the artwork, then you will have to take delivery of the item and be responsible for the cost of returning the goods to the artist.
You are now responsible for ensuring the safe return of the artwork back to the artist:

Artists take great care to package their art securely and do their utmost to ensure it arrives in good time and perfect condition. Although loss or damage of an artwork is very rare, you are advised to protect yourself against such unfortunate circumstances by taking out appropriate insurance. All items, including returns, should be sent with proof of postage and packaging backed up by adequate insurance so that matters of loss or damage can be dealt with separately.

A text message will be sent to your phone with a WAP address to complete the purchase and download. This service is not currently compatible with handsets on the Three Network.
